These Terms of Use (“Terms”) govern your access to and use of the HelloGenie AI Doctor platform (“HelloGenie,” “AI Doctor,” “Platform”), operated by GenieMD, Inc. (“GenieMD,” “Company,” “we,” “us,” or “our”).By accessing or using HelloGenie, you agree to these Terms.
1. IMPORTANT: NOT MEDICAL ADVICE HelloGenie AI Doctor is an artificial intelligence powered informational tool. It does not provide medical advice. It does not diagnose. It does not prescribe. It does not replace a licensed healthcare professional. It does not establish a physician-patient relationship.The information provided is for educational and informational purposes only. Always seek the advice of a qualified healthcare provider regarding medical conditions.
2. EMERGENCY DISCLAIMER HelloGenie is not for medical emergencies. If you are experiencing:Chest pain, Difficulty breathing, Severe bleeding, Signs of stroke, Suicidal thoughts, Any life-threatening condition Call 911 immediately or go to the nearest emergency room.
3. NO PHYSICIAN-PATIENT RELATIONSHIP Use of HelloGenie alone does not create a physician-patient relationship.A physician-patient relationship is only formed if and when:You complete a separate telehealth appointment. You are accepted by a licensed provider. You receive care from GenieMD Medical Group or another licensed medical entity. Such services are governed by separate medical consent forms and telehealth agreements.
4. AI LIMITATIONS You understand and agree that:AI responses may be incomplete, inaccurate, or outdated. AI may misunderstand user input. AI does not have access to your full medical history unless separately provided.AI outputs are generated probabilistically and are not reviewed in real time by a clinician.You assume responsibility for decisions made based on AI-generated content.
5. OPTIONAL CONNECTION TO LICENSED PROVIDERS HelloGenie may allow you to:Schedule telehealth appointments. Request lab testing. Request prescriptions (subject to provider approval). Enroll in chronic care programs. Any such services are provided by licensed medical professionals operating under applicable state laws and separate agreements. AI recommendations do not guarantee:Prescription issuance. Lab approval. Diagnosis confirmation. All clinical decisions remain solely at the discretion of licensed providers.
6. ELIGIBILITY You must:Be at least 18 years old (or legal guardian of a minor)Provide accurate information. Use the Platform for lawful purposes
7. USER RESPONSIBILITIES You agree:Not to misuse the Platform. Not to input false medical information. Not to use the AI to generate harmful content. Not to attempt to reverse engineer or manipulate the AI system
8. DATA PRIVACY & SECURITY HelloGenie may collect health-related information. If you use AI-only features, data may not constitute protected health information (PHI) unless integrated with medical services.If you engage in telehealth services, your information may be treated as PHI and governed by HIPAA.Your use is also governed by our Privacy Policy. We implement reasonable administrative, technical, and physical safeguards, but no system is 100% secure.
9. NO WARRANTIES HelloGenie is provided “AS IS” and “AS AVAILABLE.”We disclaim all warranties, express or implied, including:Accuracy. Fitness for a particular purpose. Non-infringement. Continuous availability
10. LIMITATION OF LIABILITY To the fullest extent permitted by law:GenieMD and its affiliates shall not be liable for:Indirect, incidental, or consequential damages. Medical decisions made without consulting a licensed professional delays or service interruptions. Loss of data, Maximum aggregate liability shall not exceed the greater of:$100 The amount paid by you in the past 12 months
11. INDEMNIFICATION You agree to indemnify and hold harmless GenieMD from claims arising from:Misuse of the Platform. Violation of these Terms. Reliance on AI outputs
12. TELEHEALTH & STATE LAW COMPLIANCE Medical services are provided only where legally permitted.Providers are licensed in specific states.If you are located in a state where services are unavailable, telehealth services may not be offered.
13. ARBITRATION & DISPUTE RESOLUTION Any dispute shall be resolved by binding arbitration in the State of California, except where prohibited by law.You waive the right to participate in class actions.
14. MODIFICATIONS We may update these Terms at any time.Continued use after updates constitutes acceptance.
15. TERMINATION We may suspend or terminate access at our discretion, including for misuse.
16. GOVERNING LAW These Terms are governed by the laws of the State of California, United States of America.
